Few methodological questions in fire investigation generate as much argument as negative corpus — the practice of determining a cause by eliminating other possibilities without affirmative evidence for the one selected. The reason it generates argument is that the line between it and legitimate scientific elimination is genuinely narrow, and a great deal turns on which side of that line an opinion falls.
What the term actually describes
In its problematic form, negative corpus reasoning runs: the fire started in this area, no accidental cause can be identified there, therefore the cause was incendiary. The conclusion carries no affirmative physical support. It rests entirely on the failure to find something else.
The difficulty is that the failure to find an accidental cause has at least two explanations — that none existed, or that the evidence for one did not survive or was not found. In a compartment that burned to completion, the second explanation is often at least as likely as the first, and nothing in the reasoning distinguishes them.
The guidance and how it developed
NFPA 921 has for some years addressed this directly, and the current position is unambiguous: a cause determination must be supported by evidence, not merely by the absence of evidence for alternatives. Where no cause can be established to an acceptable level of certainty, the correct classification is undetermined.
That last point is the one most often resisted, because undetermined is an unsatisfying answer for everyone involved. It is nonetheless the answer the methodology requires when the evidence does not reach further, and an opinion that reaches further without support is exposed precisely at that point.
Legitimate elimination looks different
Elimination remains an ordinary and necessary part of the method. The distinction is what it is doing. Eliminating alternatives to strengthen a hypothesis that also has affirmative physical support is standard scientific practice. Eliminating alternatives in place of affirmative support is not.
A useful test is whether the opinion would survive if the elimination were set aside. Where an incendiary determination rests on ignitable liquid residue confirmed by laboratory analysis, a pour pattern with corroborating physical characteristics, or a documented multiple-origin fire, the elimination of accidental causes reinforces a conclusion that stands on its own evidence.
Elimination has to be real
Where elimination does form part of the reasoning, it has to have actually been performed. Listing potential accidental causes and stating that each was considered is not elimination; it is an assertion that elimination occurred.
Genuine elimination means documenting what was examined and on what physical basis it was excluded — that the appliance was recovered and examined and showed no pre-fire failure, that the circuit was surveyed and its protective device was found in a particular state, that the heating equipment was inspected and its condition recorded. Each of those produces evidence a reviewer can evaluate.
The interaction with incomplete scenes
Negative corpus problems are most acute where the scene was incompletely examined, because incompleteness produces exactly the absence of evidence the reasoning then relies on. A scene excavated selectively, or examined after significant disturbance, cannot support a conclusion premised on nothing accidental being present.
This makes the quality of the scene work inseparable from the defensibility of the cause opinion. It also means that early, thorough documentation protects the ability to reach a cause determination later, and that its absence forecloses conclusions that might otherwise have been available.
Certainty, and saying what level was reached
The methodology distinguishes between hypotheses that can be held with confidence and those that remain possible but unproven. Expressing a cause opinion without indicating the level of certainty it carries invites the assumption that it is stronger than the evidence supports.
Stating that an origin area was determined with confidence while the cause remains undetermined is a common and entirely legitimate outcome. It is also more useful to the people relying on the report than an overstated conclusion that later has to be withdrawn.
Undetermined is a finding, not a failure
There is real institutional pressure against classifying a fire as undetermined. Insurers want a cause, owners want an answer, and an investigator who returns undetermined can feel as though the work produced nothing. That pressure is the mechanism by which weak cause opinions get written.
In practice an undetermined classification accompanied by a well-supported origin determination, a documented examination and a clear statement of what was excluded and why is a substantial work product. It tells the reader what is known, what is not, and what evidence would have been needed to go further — which is frequently enough to resolve the matter, and is considerably more durable than a determination that cannot be sustained.
Why this comes up in nearly every disputed matter
Cause determinations get challenged more often than origin determinations, and negative corpus is the most reliable line of attack available. It is effective because it does not require disproving the conclusion — only showing that the reasoning did not establish it.
The defence against it is structural rather than rhetorical. An opinion that identifies affirmative physical support for the cause, documents genuine elimination of alternatives, and states plainly where the evidence stops is difficult to attack on this ground. One that reports a cause reached by exclusion is vulnerable regardless of whether it happens to be correct.
